This Privacy Policy describes how Aptos, LLC together with its subsidiaries and affiliates (collectively "Aptos", "we", "us" or "our") collect, use, and share information from or about you when you use our websites or if you engage in business with us via our website or other channels (for instance, by communicating with us or attending one of our events).

We have outlined:

1. Information we collect and process

Personal data, or personal information, means any information about an individual from which that person can be identified.

We use different methods to collect personal data from and about you, such as:

a. When you visit our website

We collect personal data from you when you submit web forms or interact with our websites, for example by subscribing to our blog, signing up for a webinar, corresponding with us by phone, e-mail, chat, or otherwise, subscribing to one of our services or requesting a demo of our products and/or services. We may ask for your business email address, first and last name, job title, company name and other similar business information. You are free to explore some of our websites without providing any personal data about yourself.

b. When you use our Services

We collect usage data when you or your users use our "Services" (which means our subscription services, support, hosting, maintenance and support services and professional services) as our customer. Usage data includes but is not limited to log in details, usage metrics and information regarding your use and interaction with the Services such as what product features you use the most, when a service ticket is opened and closed. We engage third party providers to collect usage data.

c. When you register for an event

When you register for an event, we collect information such as your first and last name, job title, company name, business email address and other similar business and travel information We use this information to communicate with you and in some cases facilitate your registration. Additionally, we may share your registration data with our service providers in order to register you, make necessary arrangements to enable you to participate in the event, gain feedback, improve your experience at our events and inform you of future events.

d. Automated technologies or interactions

We may use cookies, server logs and other technologies, such as web beacons, to collect information that your browser sends us when you are using our website. This includes your computer's internet protocol, browser type, browser version, the country from which you visited our website, how you arrived at our website, length of your visit and which pages you viewed.

e. Information which we collect from other sources

We may receive personal information about you from our global network of partners and service providers who may provide your data through our lead generation and deal registration process.

We may also collect information about you through our co-marketing partnerships, for example when you sign up to a webinar or download a white paper published by our co-marketing partners.

We may combine the personal information we collect from you with personal information we receive from other sources, such as third-party providers of business information and publicly available sources (like social media platforms). This may include physical mail addresses, job titles, email addresses, phone numbers, IP addresses, and social media profiles. This helps us to update and improve our records, identify new customers, create more personalized advertising, suggest products and services that may interest you, deliver personalized communications and promote events. The collection of your personal data by these other third-party providers is governed by the provider's privacy policy.

2. How we use your personal information

We use the personal information that you provide us to:

  • to provide, maintain, and improve our website
  • monitor and analyze trends, usage, and activities in connection with our website
  • communicate with you when you use the Services, process transactions, and send technical information, including invoices
  • respond to requests from you to access, correct, or delete your information, or requests to exercise your rights under applicable law

3. Legal basis for processing personal information

Our legal basis for collecting and using personal data will depend on the personal data collected and the context in which we collect it. However, we will normally only collect personal data from you when we have your consent to do so, where we need personal data to perform the obligations under our contract with you, or where the processing is in our legitimate interests and not overridden by your data protection interests or fundamental rights and freedoms. In some cases, we may also have a legal obligation to collect personal data form you.

If we ask you to provide personal data to comply with a legal requirement or to perform a contract with you, we will make this clear at the relevant time and advise you whether the provision of personal data is mandatory or not (as well as the consequences if you do not provide your personal information). Similarly, if we collect and use your personal information in reliance on our legitimate interests (or those of any third party), we will make clear to you at the relevant time what those legitimate interests are. Typically, our legitimate interests comprise of the following:

  • Customer and product administration: to provide you with our Services and information that you requested or that you access through our Services, create product accounts, provide user and technical support, enforce our terms of business, report product usage information to our customers and business partners, report to or content and technology providers, contact you about renewal of your subscriptions, and other related administrative tasks.
  • Marketing: to send you marketing messages for our Services that may interest you. We do not disclose your contact information to third parties for their marketing purposes.
  • Security: to protect the security of our IT systems, architecture and networks as well as to prevent misuse of our products and services.
  • Legal rights: to exercise our rights and to the extent reasonably required, to assist third parties (such as your employees or business partners) in exercising their rights, and to defend ourselves from claims and to comply with laws and regulations that apply to our group or third parties with whom we work.

4. Who we share your personal information with

We may share your personal information with:

a. Our group companies

In addition, your business information may be shared for business operational purposes.

b. Service providers and sub-processors

We may share your personal information with our third-party service providers and sub-processors to support our websites, products, and Services. For example, we use service providers and sub-processors for data hosting, application development, marketing, sales support and customer support. We may need to share your information with them to provide information about products or Services to you. Examples may include removing repetitive information from prospect lists, analyzing data or performing statistical analysis on your use of the Services or interactions on our websites, providing marketing assistance, developing and improving the product and services, and providing customer service or support. These service providers and sub-processors are prohibited from using your Personal Data except for these purposes, and they are required to maintain the confidentiality of your information. In all cases where we share your information in this way, we explicitly require them to acknowledge and adhere to our privacy and data protection policies and standards.

c. Compelled disclosure

We reserve the right to use or disclose your personal information if required by law or if we reasonably believe that use or disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or comply with a law, court order, or legal process.

5. Your rights

Depending on which country or state you are a resident in, you may have certain rights with respect to your personal information which we hold about you including the following:

a. Access, correction or deletion

You can request access, correction, updates or deletion of your personal information.

b. Objection or right of data portability

You can object to our processing of your personal data or ask us to restrict processing of your personal data or request portability of your personal data.

c. Withdraw Consent

If we have collected and processed your personal data or information with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal data or information conducted in reliance on lawful processing grounds other than consent.

d. Complaint

You have the right to complain to your local data protection authority about our collection and use of your personal data or information.

We will respond within the time period prescribed by applicable law. Please note that many of the above rights are subject to exceptions and limitations. Your rights and our responses will vary based on your state or country of residency. Please note that you may be located in a jurisdiction where we are not obligated, or are unable, to fulfill a request.  In such a case, your request may not be fulfilled. If you have any unresolved concerns, you may have the right to complain to your local data protection authority.

Please note that to protect personal information, we may verify your identity by a method appropriate to the type of request you are making. Depending on where you reside, you may be entitled to empower an “authorized agent” to submit requests on your behalf. We will require authorized agents to confirm their identity and authority, in accordance with applicable laws.

Aptos, LLC and its affiliates and subsidiaries may collect the personal information of individuals who are resident in the state of California, USA ("consumers" or "you").

The defined terms used in this Notice shall have the same meanings ascribed to them in the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 ("CCPA").

Where applicable, this California Privacy Notice (this "Notice") will apply to you, in addition to the information contained in our Privacy Policy, this Notice describes how we collect, sources, use, disclose and otherwise process your personal information, offline and online, within the scope of the CCPA.

Personal Information Disclosures

When we use the term "personal information" in this Notice, we mean information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household in accordance with the CCPA.

For the purposes of this Notice, personal information does not include:

Recipients of Personal Information

We share personal information internally among Aptos' affiliates (please refer to https://www.aptos.com/contact and https://revionics.com/contact-us for a list of our affiliates) and with our service providers and contractors that help us operate this website and our business. We may also share personal information with a variety of third parties, including for marketing purposes; if we are subject to certain corporate transactions or reorganizations; with third parties to comply with law or to protect our rights or the rights and safety of others; or for purposes otherwise disclosed.

For purposes of this Notice, when we use the term "third party" we mean entities that are not service providers or contractors providing services on behalf of Aptos and that are not entities with whom you interact with directly.

In the last 12 months, we have collected each of the categories of personal information noted below and disclosed it, for a business purpose, to the categories of recipients listed below. The sections below also indicate when we sold or shared the personal information to third parties in the last 12 months and the types of third parties.

a) We may disclose, for a business purpose, the following categories of personal information to third parties:

  • Identifiers, such as names, email address, postal address and job titles
  • Commercial Information including records of products or services purchased, obtained or considered, or other purchasing or consuming histories or tendencies.

Sources of Personal Information

As described our Privacy Policy, we collect personal information directly from you when you provide it to us, automatically using cookies and other tracking technologies, from the categories of third parties listed in that policy and by combining personal information we may otherwise obtain.

Purposes for Collecting Personal Information

We collect, sell, share or disclose personal information about you for the business and commercial purposes further described in the "Legal basis for processing personal information" section of the Privacy Policy including to:

  • Analyze, improve and prevent the misuse of our website;
  • Respond to inquiries and otherwise communicate with customers or individuals inquiring about our product offering or events;

Right to Know

The right to request the following information relating to the personal information we have collected about you and disclosed about you:

  • The categories of personal information we have collected about you;

  • The business or commercial purposes for collecting, selling, or sharing the personal information;
  • The categories of third parties with whom the business shares personal information;

Right to Access (Right to Know Specific Pieces of Information) / Portability

The right to access and obtain a copy of the specific pieces of personal information we have collected about you in a structured, machine-readable format that may be transmitted to another entity without hindrance, to the extent technically feasible.

Right to Correct

The right to request that we correct your inaccurate personal information maintained by us.

Right to Request Deletion

The right to request the deletion or erasure of personal information we have collected from you, subject to certain exceptions.

Right to Opt-Out of Data Sales or Sharing

The right to direct us not to sell or share personal information we have collected about you to third parties, including for ad targeting/cross contextual advertising.

California's "Shine the Light" law (Civil Code § 1798.83) also permits California residents that have an established business relationship with us to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes during the immediately preceding calendar year or to have the right to opt-out of such disclosures.

We may need to verify your identity and confirm you are a resident of the State of California before processing most requests, which may require us to obtain additional personal information from you. In order to verify your identity, we will generally require either the successful authentication of your account, or the matching of sufficient information you provide us to the information we maintain about you in our systems.

Please provide your name, email address and mailing address in the original request, as well as an explanation of the rights you wish to exercise. We will only use the personal information provided in connection with the US Privacy Rights Request Form to review and comply with the request. If you do not provide this information, we may not be able to verify or complete your request in all circumstances.

If you wish to submit a verifiable consumer request on behalf of another individual we will also need sufficient information to verify that the individual is the person about whom we collected personal information and that you are authorized to submit the request on their behalf. Please see the "Authorized Agents" section below for more information.

In certain circumstances, we may decline a request to exercise the rights described above, in accordance with applicable law.

To exercise your Right to Opt Out of Personal Information Sales or Sharing, we may ask you to provide additional personal information (including your name, email address and mailing address) so that we can properly identify you in our dataset to facilitate the opt-out request.
